The federal court ruled the state's ban on concealed-carry is unconstitutional. So, defense attorneys are trying to use that argument in court to get charges dropped.
It actually happened in Sangamon County. A man was charged with aggravated unlawful use of a weapon.
His lawyer asked the judge to dismiss the case using that argument. But, the judge denied his request. He says they have to uphold current state law.
They're not the only ones. Prosecutors are doing the same, and they will continue to until lawmakers pass a new concealed-carry law.
A federal court struck down the state's ban on concealed-carry last year and gave lawmakers six months to come up with a new law to allow it. There are only two months left to make that happen. Lawmakers are still divided about what to do.
