Lawyers want time to determine mental fitness

COLES COUNTY, Ill. (WCIA) -- A mother, accused of killing her 2-year old son, was in court Monday.

Police say 22-year old Savannah Weiss, of Charleston, left her son, Malachi England, alone for more than two days. When she finally checked on him, he was dead.

Weiss has been in jail for almost two months. Monday, she didn't say anything in court. Her attorney says he needs more time. Weiss is being tested to see if she's fit to stand trial.

The outcome will determine whether the defense will go for an insanity plea. She's accused of going out to eat with friends while her son was starving to death just blocks away.

Weiss claims she left the baby with two peanut butter and jelly sandwiches, but when police got to the home, a detective said there was so much spoiled food under the playpen, he couldn't tell. What he reported seeing was a bowl of chicken strips, a pillow and the lifeless toddler.

If convicted, Weiss faces life in prison. She'll be back in court next month.
