Wrongful Death Lawsuit at Issue

VERMILION COUNTY -- The lawyer representing Vermillion County in a lawsuit hopes to get part of the case thrown out. You may remember Michael Brandel. He was shot to death by one of three deputies responding to a disturbance call at his home in 2010.
    Managers of Brandel's estate are suing Deputies Tom Cruppenink, Pete Miller and Doug Miller, as well as Sheriff Pat Hartshorn and Vermilion County. Defense lawyer, Michael Condon, says he filed a motion to dismiss the charges against Hartshorn and the county since there's no legal basis to hold either liable.
    He also denies the allegations made against the deputies, stating they had to use deadly force since Brandel threatened them with a weapon.
