Judge rejects probation plea deal in fatal accident

PHILO -- An area woman was in court Monday and faces five years behind bars for a fatal accident. Katheryn Daly pleaded guilty to reckless homicide for the death of her 19-year old cousin, Annie.

Jail time isn't what anyone wanted in the situation. Daly's family, lawyer and the Champaign County State's Attorney were trying to avoid it. Ten days ago, they offered a plea deal to the judge to sentence her to probation and 180 days house arrest, but he denied it.

It was a different story in court Monday. Daly's family surrounded her as the judge accepted her guilty plea of reckless homicide. The October crash killed her cousin while Daly drove an ATV.

She admitted drinking beforehand, but two counts of aggravated DUI were dismissed with the plea agreement. She could have faced 3 - 14 years behind bars on those counts, but now she's looking at 2 - 5.

Probation or boot camp are still options. She'll be sentenced in May. Her lawyer asked the judge to block a lot of time out for that hearing so they can come to the right decision.
