Jurors won't go to crime scene

LINCOLN -- The jury deciding the fate of a Logan County man won't be allowed to see the actual crime scene. A judge denied a defense motion to allow the jury to visit a Beason home where a family of five was killed. WCIA-3's Steve Staeger has details from inside the courtroom.

Cameras were rolling as Christopher Harris walks out of court after his defense team takes a bit of a defeat. The judge in the case ruled the jury won't be allowed to visit the home in Beason where the gruesome murders took place more than three years ago.

It's where prosecutors say Harris killed Rick and Ruth Gee and three of their children. It's also where defense attorneys claim Harris walked in on a 14-year old boy killing his own family.

The defense claims blueprints and pictures of the home make it seem bigger than it really is. They add Harris didn't have any injuries at the time of his arrest, making it seem unlikely he could have killed five people in such a small space.

But, prosecutors argue the house has changed a lot in the three years since the crime. It's been sealed to the public, but not to the elements.

Mold is growing, a ceiling has collapsed and it could be a hazard. The judge agreed and said the jury has plenty of evidence, including thousands of pictures.

Another issue addressed in court is WCIA-3's interview with Dan Fultz. The prosecution claims they could taint the jury pool in Peoria, and they wanted it moved to another location.

The judge placed a gag order on all attorneys forbidding them to speak to the media before trial. But, he refused to delay the trial any longer and wouldn't move it to another location.

Defense attorneys declined to comment after court. The trial starts April 29. The court did move the case to Peoria out of concern Harris couldn't get a fair trial in Logan County.
