Driver faces felonies for fatal accident

MONTGOMERY COUNTY -- The State's Attorney's Office announced charges in the death of Illinois State Trooper Kyle Deatherage.
MONTGOMERY COUNTY -- The State's Attorney's Office announced charges in the death of Illinois State Trooper Kyle Deatherage. He was killed in the line of duty when he was struck by a semi-truck on I-55 near Litchfield in November 2012. The 32-year old motorcycle officer was performing a traffic stop when he was struck.

52-year old Johnny Felton, Jr., of Hinesville, GA, faces two felony charges, including reckless homicide, related to the accident. Monday, a grand jury returned a two-count indictment alleging Felton recklessly drove the semi by failing to reduce speed or change lanes when approaching the roadside traffic stop.

The second count states Felton did not have a valid commercial driver's license and was only allowed to provide intrastate, not interstate, commerce. He was taken into custody Tuesday morning in Georgia and has waived extradition. He'll be brought to Illinois for arraignment of the charges. 

His bond is set at $250,000. Sentencing for the charges ranges from probation to 14-years in prison.
